Types of Sex Offense Charges
All Criminal Sexual Assault
In Illinois, a person may be charged with criminal sexual assault when the State alleges that the person committed an act of sexual penetration and one of several circumstances existed, including that:
- Force or the threat of force was used, or
- The accused knew the other person was unable to understand the nature of the act or give knowing consent, or
- The alleged victim was under 18 and the accused was a family member, or
- The alleged victim was between 13 and 17 years old and the accused was 17 or older and held a position of trust, authority, or supervision in relation to the alleged victim.
Criminal sexual assault is a serious felony offense. Depending upon the circumstances and a defendant's criminal history, a conviction can result in a lengthy prison sentence, mandatory sex-offender registration, and consequences that can continue long after the criminal case has ended. Allegations of sexual assault frequently turn on issues of consent, credibility, communications between the parties, forensic evidence, electronic records, and what occurred before and after the alleged incident.
